Earnhardt public warning clears record

June 5, 2002 - Race car driver Dale Earnhardt, Jr. is airing public warnings about trespassing as part of a deferred prosecution agreement.

Earnhardt agreed to make the public service announcements informing people it is illegal to ride a four-wheeler on other people’s property without permission after he was charged with trespassing with his  own four-wheeler earlier this year in eastern Lincoln County.

The announcement, made at Earnhardt’s expense, lasts 17 seconds and will be played during a three-month period. The agreement included airing the announcement on two radio stations: one AM and one FM. It can be heard on WLON, 1050 AM. An FM station has not yet been selected.

In the tape Earnhardt says he enjoys riding four-wheelers and tells others to be sure to get permission from property owners first, said Lincoln County Sheriff’s Chief Deputy Bill Beam.

Assistant District Attorney Kay Killian said the tapes are a way to get word out not to trespass.

“I think it’s a good solution,” said Killian.

“Any deferment would require more of a person than if they pleaded guilty,” said Killian. “The trade-off is no criminal record with deferment.”

Deferred prosecution is available to persons with no criminal record who are cooperative with law enforcement officers.

The incident occurred Feb. 3 in the Denver area. Earnhardt was cited with trespassing on private property on Dusty Ridge Court off Catawba Burris Road.

Earnhardt was charged along with five other people. Three simply pleaded guilty and paid a fine. Two others are doing community service.
