A Concord felon who attempted to suck on a woman’s toes at a Lincolnton Wal-Mart on Monday has waived his right to a court-appointed attorney.

Detectives said Monday’s incident was at least the fourth time the man has tried to perform the sexual act on strangers in public.

Concord Police arrested Michael Brown, 31, on Thursday, just hours after Lincolnton Police Department issued a press release asking the public’s help in identifying the man, whose image was captured on the Lincolnton store’s video surveillance, officers said.

The victim told police that Brown claimed to be a student studying podiatry and asked her to try on several shoes for him before he stuck her foot in his mouth, sucking her toes.

The victim protested the man’s actions, prompting him to suggest he pay for her groceries, police said.

Brown appeared in district court Friday for one count of assault on a female.

Clerk of Court officials said the defendant chose to forego a court-appointed attorney, meaning he will either seek an outside lawyer or represent himself. Officials were not sure yet as to which choice Brown would make.

Detectives have revealed how the incident, which took place Monday at the Wal-Mart store on North Generals Blvd., was not Brown’s first attempt to lure a woman into taking off her shoes so he could suck her toes.

He not only tried to carry out similar behavior at the Wal-Mart store on N.C. 73 in Denver that same morning, but also was convicted of assault on a female last year in Stanly County, Det. Dennis Harris said.

The incident took place at a Wal-Mart store in Locust.

An alleged third victim also recently told Lincolnton police that Brown attempted to touch her feet, too, at a K-Mart store in Monroe.

A Cabarrus County judge found Brown guilty of felony second-degree sex offense in 2001, public records showed.

Harris said during the Concord incident the suspect entered a woman’s residence with a knife and used her feet to masturbate.

Brown, who remains behind bars under a $50,000 bond, is set to make a second court appearance on April 10, Clerk officials said.
