Judge’s right to seek re-election challenged

A Lawndale man has challenged the right of District Court Judge Anna Foster to seek re-election, claiming he has evidence that she no longer resides within District 27B, which includes Cleveland and Lincoln counties.

A hearing on the challenge before a joint session of the Lincoln and Cleveland County Boards of Election is slated for 9 a.m. Friday at the Cleveland County Commissioners chambers, located at 215 Patton Street in Shelby.

Judge Foster is currently seeking re-election to her seat without any filed opposition.

Should a challenge to her candidacy and qualification to complete her current term result in a vacancy, North Carolina General Statute 7A-142 provides for her seat to be filled by gubernatorial appointment within 60 days.
